Court for Tioga County Convened Monday, May 23.
The case of the Commonwealth versus Samuel Horwitz was called for trial late Monday afternoon. Samuel Horwitz is charged with illegally selling liquor within the borough of Wellsboro.
The following jurors were drawn and sworn for the trial of the case: Lafayette O'Dell, Royal Watkins, Fred Weaver, Charles Swanson, Floyd Mase, Warren Miller, Albert Herman, David Lowden, Norman Smith, Arthur R. Outman, Charles Copley, John E. Lewis.      The Commonwealth called only three witnesses, proving sales of cider to two of them, both of whom said the cider had an intoxicating effect. The third witness, who saw the other two just as they came out of the Horwitz house, said they were visibly intoxicated. The defendent offered no evidence. The sales were not contradicted. Paul J. Edwards, Esq., representing Mr. Horowitz, interposed objections at various stages of the proceedings, on the grounds that the defendant could not be convicted under the law as it stands at the present time, that the Volstead Act and the National Constitution have rendered the Brooks Law inoperative, that the amendment to the Brooks Law just made has covered the offence, and it was never covered before; also that there could never be a conviction for selling cider, since it was not a vinous, spiritous, malt or brewed liquor. The court overruled these and all other objections, and sent the case to the jury at 10:15 a.m. Tuesday. The jury returned a verdict of guilty at 11 a.m. Distict Attorney Charles M. Elliott and F. H. Rockwell, Esq., conducted the prosecution.
